ZeroMe Terms and Conditions of Use

Welcome to ZeroMe.com (the “Site”). BreakthroughFuel, LLC (“we” or “us” or “BTF”) provides this Site, subject to your acceptance of these Terms and Conditions of Use (the “Terms”), primarily to deliver information regarding our sustainable living program ZeroMe (“ZeroMe” or the “Program”). Your use of this Site is conditioned upon your acceptance of these Terms. By accessing or using this Site in any manner, you agree to be bound by these Terms. Please read the Terms carefully. If you do not accept all of these Terms, do not use this Site. If you wish to terminate your agreement to these Terms at any time, you can do so by no longer accessing or using our Site. Please review our Terms periodically for changes, which will be posted to the Site. Your continued use of the Site will mean you accept the revised Terms.

Use of the Site

As a condition of using this Site, you represent that (i) you are at least 18 years of age; (ii) all information supplied by you on this Site is true, accurate, current and complete; and (iii) you have the legal right to submit such information to the Site.

You agree to use the Site in a respectful, professional manner, and in compliance with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements.

We have the right, but not the obligation, to monitor the Site to determine compliance with these Terms and any other operating rules we have established and to satisfy any law, regulation or authorized government request.

All trademarks, service marks and trade names are trademarks or registered trademarks of and are proprietary to BTF or other respective owners that have granted BTF the right and license to use such marks. Such trademarks and content may not be used except as provided in these Terms or in the text of the Site. “ZeroMe” and other graphics, logos, designs, page headers, button icons, scripts, and service names available on the Site are the trademarks of BTF, Inc. and may not be copied, imitated or used, in whole or in part, without the prior written permission of BTF.

By using the Site you agree that, except as expressly permitted by BTF, you will not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any Content;
  • Use this Site or the Content for any commercial purpose, including, without limitation, renting, leasing, loaning, trading, selling/re-selling or otherwise monetizing the Site or related data or access to the same;
  • Monitor the Site’s availability, performance or functionality for any competitive purpose;
  • Access, monitor or copy any content or information of this Site using any robot, spider, scraper or other automated means or any manual process for any purpose;
  • Bypass or circumvent other measures employed to prevent or limit access to this Site;
  • Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
  • “Frame,” “mirror” or otherwise incorporate any part of this Site into any other website;
  • Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by BTF in connection with the Site or the Services;

Liability Disclaimer

The Site, Content and services available on the Site are provided on an “as is” and “as available” basis. We do not guarantee the accuracy of any information on the Site. BTF does not make any representations or warranties with regard to the Site, the Content or services available on the Site, whether express or implied, of any kind, including but not limited to, warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose. We expressly disclaim any and all implied warranties to the fullest extent permitted by applicable law.

You use the Site at your own risk. We do not guarantee that anything on the Site is free from viruses, malware, or other components that may be harmful or damaging to your computer or data. We may include or offer products or services on the Site, which shall not constitute an endorsement or recommendation of such products or services by BTF. We may also provide links to other websites. We do not endorse or make any representations about these sites, any information, products or materials found on them, or any results obtained by using them. We have no responsibility for the content of such other websites and shall not be liable for any damages arising from the content of such other websites. 

Limitation of Liability

YOU ACKNOWLEDGE AND AGREE THAT BTF (INCLUDING ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES AND SUBSIDIARIES) SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, YOUR ACCESS TO, DISPLAY OF OR USE OF THE SITE OR WITH THE DELAY OR INABILITY TO ACCESS, DISPLAY OR USE THE SITE WHETHER BASED ON A THEORY OF NEGLIGENCE, CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF BTF HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF ANY PORTION OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID, BTF’S LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Indemnification

You agree to indemnify and hold harmless BTF, its affiliates and subsidiaries, and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, fines, penalties or other costs or expenses (including but not limited to court costs and reasonable legal and accounting fees), brought by third parties as a result of (i) your breach of these Terms or your violation of any law or the rights of a third party; (ii) your use or inability to use the Site; or (iii) your intentional or negligent misrepresentation or misuse of confidential or protected information, including personally identifiable information and BTF’s intellectual property.

Governing Law

The Site is operated by a U.S. entity and these Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict of law or choice of law rules. You hereby consent to the exclusive jurisdiction and venue of courts in Wisconsin, USA and stipulate to the fairness and convenience of proceedings in such courts for all disputes arising out of or relating to the use of the Site. We make no representation that our Site is appropriate, legal or available for use in locations outside of the United States. If you choose to access our Site you agree to do so subject to the laws of Wisconsin and the United States.

General

If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remaining provisions in the Terms shall continue in effect. You agree that these Terms and any other documents referenced herein constitute the entire agreement between you and BTF pertaining to you use of the Site. We may amend these Terms or any other referenced documents at any time by posting the amended documents on the Site. Any amended or modified terms will be effective upon posting.
